UK’s First Trans Judge Appeals To ECHR Over Supreme Court Ruling

Dr Victoria McCloud, the UK’s first transgender judge, has lodged an appeal with the European Court of Human Rights against the Supreme Court’s April decision that defined “woman” in the Equality Act strictly as biological sex.

The ruling excluded trans women, including those with Gender Recognition Certificates, from legal protections.


McCloud argues that her Article 6 rights to a fair trial were breached after she was denied the chance to intervene or present evidence while opposing groups were allowed to do so.

She is represented by Oscar Davies, the UK’s first openly non-binary barrister, and Olivia Campbell-Cavendish, the country’s first black trans lawyer.
