Court of Appeal Overturns Epping Asylum Hotel Injunction

The Court of Appeal has overturned an injunction that would have prevented the Bell Hotel in Epping from being used to house asylum seekers.

The Home Office successfully argued that the rights of illegal migrants outweighed local people’s safety concerns.

Judges ruled that the original decision was “erroneous” as it denied the Home Office the right to participate in proceedings.

The court warned that temporary injunctions risk incentivising unlawful protests and encouraging more councils to seek similar restrictions.

“If an outbreak of protests enhances the case for a planning injunction, this risks encouraging further lawlessness,” the judgment stated.
